The process of winding up is the compulsory liquidation of a limited company.
In contrast to voluntary liquidation where the directors agree that the company should be closed, winding up is used if one or more creditors want to force the closure of a business against the wishes of the directors.
Any creditor who is owed more than £750 and has not received payment after carrying out reasonable collection activities can apply to the Court to wind up a company.
If the application is successful the company will be forced to stop trading and will be closed. The company's assets will be sold and all employees will be made redundant.
For this reason if a company is threatened with winding up, this could have very serious implications for the business.
